GRND Terms of Service

1. Acceptance of Agreement

By accessing our website, creating a GRND account, joining our early-access waitlist, purchasing hardware, or pairing a GRND wearable with our applications, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

2. Eligibility & Account Security

You must be at least 18 years of age (or the age of legal majority in your jurisdiction) to purchase devices and maintain a GRND account. By using the Service, you represent that you have the legal capacity to enter into a binding contract.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access at grndfitnessindia@gmail.com.

3. Prototype Devices & Visual Representations

Product images, 3D renderings, and physical specifications shown on this website represent conceptual prototype models and early manufacturing iterations. The final manufactured device and firmware may vary in cosmetic finish, weight, sensor module positioning, and peripheral dimensions as engineering validation progresses.

Wearable hardware must be used strictly according to the accompanying battery safety instructions, charging guidelines, and skin-contact maintenance recommendations.

4. Software License & Intellectual Property

GRND grants you a revocable, non-exclusive, non-transferable, limited license to access and use our mobile and web applications solely for your personal wellness tracking.

All trademarks, patents, proprietary baseline algorithms, neural network models, interface designs, firmware, and codebases are the exclusive intellectual property of GRND Technologies Inc. You agree not to reverse-engineer, decompile, or extract firmware binaries or proprietary algorithmic models from the wearable or cloud APIs.

5. User Content & Clinical Sharing

You retain all ownership of the biological telemetry and uploaded lab documents you transmit to GRND. You grant GRND a limited, worldwide license to host, store, and process this data strictly as required to generate your personal health baseline and provide the service in compliance with our Privacy Policy.

When you generate a "Doctor Summary" or share physiological reports with clinical practitioners, you acknowledge that you do so voluntarily and bear sole responsibility for how third-party clinicians interpret or act on such reports.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GRND TECHNOLOGIES INC., ITS DIRECTORS, EMPLOYEES, OR PARTNERS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES, OR ANY LOSS OF LIFE, HEALTH COMPLICATIONS, PROFITS, OR DATA ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE SERVICE.

GRND DOES NOT GUARANTEE UNINTERRUPTED SENSOR READINGS, COMPLETE ARTIFACT ELIMINATION IN NOISY OPTICAL PPG SIGNALS, OR ABSOLUTE ACCURACY OF THIRD-PARTY DEVICE INTEGRATIONS.

7. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms, engage in unlawful activity, or attempt to tamper with our hardware/software security mechanisms. Upon termination, your right to use the Service immediately ceases, and you may request an export of your health data within 30 days.

8. Governing Law & Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be resolved through binding confidential arbitration administered in accordance with the American Arbitration Association.
